INTRODUCTION

In this privacy policy we describe how Live Technologies processes your personal data when
you contact us, conclude contracts with us, visit our website or use LiveSoft software
applications.

Please review the privacy policy carefully. LiveSoft may make changes to the privacy policy
from time to time. The up-to-date privacy policy is published on LiveSoft’s website
www.livesoft.ee

1. DEFINITIONS

Company: Live Technologies OÜ, the provider of the livesoft.ee application service
hereinafter LiveSoft.

Personal data are any data about an identified or identifiable natural person. Processing
means any operation performed on personal data such as collection, storage, modification,
use, viewing, deletion and destruction.

Data subject is the natural person whose personal data are processed by LiveSoft. Data
subjects may for example be LiveSoft’s individual-person clients, visitors to the website or
other persons who turn to LiveSoft. In the privacy policy the data subject is also referred to as
“you” or “client”.

Controller is the person who determines the purposes and means of processing personal data
and is primarily responsible that the processing of personal data takes place lawfully and that
the rights of data subjects are ensured. For the purposes of this privacy policy the controller
of your personal data is Live Technologies OÜ.

2. WHAT PERSONAL DATA DO WE PROCESS?

When you approach LiveSoft for the provision of a service we have to process data about
you, which also include personal data. The personal data we process about you depends on
the specific contractual or pre-contractual relationship between you and LiveSoft. The
personal data we process about you may include the following data:

  •  first and last name;
  •  personal identification number or date of birth;
  •  identity document data;
  •  contact details (address, e-mail, telephone number);
  •  other contract-related information (time of contract conclusion, price, payment
  • information or other information specified in the contract);
  •  vehicle information (vehicle make, model, registration numbers, other information
  • describable in the system).

LiveSoft has the right to verify the accuracy of the personal data you have provided
and to collect additional data about you from public sources, for example to check the
validity of the driver’s licence when concluding a test-drive agreement. LiveSoft does
not in any case collect data about you from non-public sources.

3. FOR WHAT PURPOSES DO WE PROCESS YOUR PERSONAL DATA?

LiveSoft processes the client’s personal data in connection with fulfilling the contract for the
following purposes:

  •  identifying the client for the purpose of performing and ensuring the contract;
  •  communicating with the client for the purpose of performing and ensuring the
  • contract;
  •  responding to the client’s inquiries and requests;
  •  preparing and sending invoices to the client;
  •  managing and analysing the client base to improve availability, selection, quality of
  • goods and services etc., and to make the best offers to clients;
  •  fulfilling the statutory obligation, for example fulfilling accounting obligations;
  •  other processing based on LiveSoft’s legitimate interest, provided that LiveSoft’s
  • legitimate interest does not outweigh the data subject’s rights.

4. PROCESSING OF PERSONAL DATA WHEN APPLYING FOR WORK AT LIVESOFT

If you apply for a job at LiveSoft, we process the data you have disclosed to LiveSoft in your
CV and/or cover letter.

When applying for a job you have the right to know what data we have collected about you,
to access the data we have collected, to give explanations about those data and to submit
objections. A candidate also has the data subject rights specified in this privacy policy and
under applicable law.

In LiveSoft only LiveSoft-authorised employees participating in the specific recruitment
process and other third parties who may assist us in the recruitment process (personnel search
firms) or competent authorities to whom access must be granted under law have access to the
candidate’s data.

LiveSoft processes the candidate’s data for the purpose of assessing the candidate’s suitability
for the free position at LiveSoft.

For the selected candidate LiveSoft uses the data for concluding the employment contract. If
necessary we ask for additional data from the person. The conditions for processing employee
data are set out in LiveSoft’s employee privacy policy.

For candidates who are not selected, the data are retained for up to one year after the
recruitment decision, after which paper-based data are destroyed and electronic and
personnel-search portal data are deleted.

Provided that we have received separate consent from the candidate, we may retain the data
of non-selected candidates for the purpose of making offers to non-selected candidates to
participate in future contests.

5. USE OF LIVESOFT’S WEBSITES AND APPLICATIONS

LiveSoft enables its clients via its website to access content of interest. Through LiveSoft’s
applications you can manage your shipments by different modes of transport either for your
own transports or as a service provider. Also customs declaration preparation, management
and submission to the Tax and Customs Board as well as company data and file retention for
the company’s own or statutory obligations.

In the case of LiveSoft’s applications, when a request is made we only process the data that
you have transmitted to us when submitting your request. If you or your clients submit a
request to us via the application or use the application service, then we process your personal
data only for the purpose of responding to your request or managing the service for you. The
data processed by the service may include the following personal data:

  • first and last name;
  • postal address and postal code;
  • contact details (e.g. e-mail address and/or telephone number);
  • data about your vehicles and other information that you transmit to LiveSoft when
    using the application service.

LiveSoft’s websites use cookies. Cookies are small text files that the web server sends
to the user’s browser and that are stored on the user’s computer hard drive. Our
websites use cookies for the purposes of identification, analysis and advertisement.
The cookies of LiveSoft’s e-services store the following data about you:

  •  data about your hardware and software (your browser type, operating system);
  •  IP address;
  •  times of visiting LiveSoft’s website;
  •  the address of the website referring you to LiveSoft’s website.

By using the website you give your consent to the storing of cookies on your device
and access to them. You have the right to disable the use of cookies at any time, but if
you decide to disable cookies, it may happen that not all parts of the website will

LiveSoft’s websites may also contain links to third-party websites. LiveSoft is not
responsible for the content and security of third-party websites and the use of third-
party websites is at the client’s own risk.

LiveSoft’s websites may also include content with iFrame tags that originate from
third-party websites. By clicking on an iFrame tag, LiveSoft is not responsible for the
third-party content displayed in the iFrame tags. The information displayed there is
the full responsibility of the owners of those websites.

6. DISCLOSURE OF PERSONAL DATA

In certain cases LiveSoft may disclose your personal data to third parties in the European
Economic Area. LiveSoft may disclose your personal data to:

  • LiveSoft’s collaboration partners to whom data disclosure is necessary for providing the best application service, for example IT service providers, server service providers etc;
  • other authorised processors of LiveSoft or authorities.

When using authorised processors, LiveSoft uses only those authorised processors
who guarantee an adequate level of data protection under EU law. If you have more

7. RETENTION OF PERSONAL DATA

LiveSoft retains your personal data in a form that allows you to be identified only for as long
as necessary for the purpose of collecting personal data or justified based on LiveSoft’s
legitimate interest, provided that LiveSoft’s legitimate interest and the impact on the rights
and freedoms of the data subject are balanced.

When retaining personal data we follow the following retention periods:

  •  Data collected for the purpose of concluding a contract are retained as long as they are required in connection with performance of the contract during the term of the contract or up to 3 years after the contract ends;
  •  Accounting primary documents are retained for 7 years;
  •  Data collected via enquiries through websites are retained for 1 year;
  •  Information obtained via cookies from websites is retained for 540 days.

After the retention period has expired, paper-based personal data are destroyed and electronic personal data are deleted. If you wish to receive more detailed information

8. YOUR RIGHTS IN RELATION TO YOUR PERSONAL DATA

LiveSoft ensures that data subjects have all rights arising from applicable legislation. In
relation to the processing of your personal data, you have the following rights:

  •  Right of access to data, which means that you have the right at any time to ask whether LiveSoft holds personal data about you and the right to receive information about which personal data LiveSoft processes about you;
  •  Right to rectification of personal data, which means that you have the right to request LiveSoft to correct or complete your personal data if they are inadequate, incomplete or incorrect;
  •  Right to object, which means that you have the right to raise objections with LiveSoft concerning the processing of your personal data;
  •  Right to erasure of personal data, which means that you have the right to request that LiveSoft delete your personal data, for example when personal data are processed on the basis of your consent and you have withdrawn your consent;
  •  Right to restriction of processing, which means that you have the right to request that LiveSoft restrict the processing of your personal data, for example if LiveSoft no longer needs your personal data for processing purposes or you have raised an objection to processing;
  •  Right to withdraw consent given for processing of personal data, if the processing of personal data is based on your consent;
  •  Right to data portability, which means that you have the right to receive the data you have submitted to LiveSoft electronically in writing or in a commonly used electronic format, and, if technically feasible, to request that LiveSoft transmit those data to a third‐party service provider;
  •  Right to lodge a complaint with the supervisory authority, which means that if you find that your rights in regard to the processing of your personal data have been violated you may submit a complaint to the Andmekaitse inspektsioon (Estonian Data Protection Inspectorate) at info@aki.ee.

Please remember that the rights listed in this chapter are not unlimited rights. In
certain cases the rights of other data subjects, LiveSoft’s legitimate interests or
LiveSoft’s legal obligations may limit your rights.

The privacy conditions are subject to the laws of the Republic of Estonia.
